Step 2. Legal Considerations

Identify who is causing the issue

Condos are required to maintain a record of owners and mortgagees under section 46.1 of the Condo Act and a record of leased units under section 83 (3) of the Condo Act.

Contact those responsible

The responsible parties may not know that they are causing an issue, so speaking to them about it may resolve the issue quickly.

Send a letter if you are unable to speak with them or speaking with them has not changed the situation. You can use the CAO’s letter templates at the bottom of this page.

Owners are responsible for ensuring that occupants of their units comply with the Condo Act and the corporation’s governing documents under section 119 of the Condo Act.
